These Terms and Conditions (“Terms”) govern the relationship between Photo Trips (“we,” “our,” “us”) and photographers (“you,” “your”) who provide photography services through our platform. By joining Photo Trips as a photographer, you agree to comply with these Terms and our Privacy Policy, which is incorporated herein by reference.
Section 01
Booking Availability & Calendar Management
- Photographers must keep their Photo Trips calendar accurate at all times.
- Any open time slot on the calendar is considered available for automatic booking.
- If a photographer receives a booking but is not available, they must first attempt to reschedule the session directly with the customer.
- If rescheduling is not possible, the photographer must immediately notify Photo Trips so we can attempt to assign a replacement photographer.
- If no replacement is available, the booking will be canceled and the customer will receive a full refund.
- If a photographer needs to cancel a confirmed booking, they must notify Photo Trips at least 48–72 hours in advance.
- Repeated cancellations may result in reduced visibility or declassification of listings on the platform, and in extreme cases, account suspension.
- Frequent unavailability despite open calendar slots may also result in suspension or removal from the platform.
Section 02
Photographer Punctuality
- Photographers must arrive at the agreed meeting point on time, ready to start the session at the scheduled time.
- If late, the photographer must extend the session by the same amount of time they were delayed, unless the customer agrees otherwise.
- Repeated lateness may result in temporary suspension of listings or removal from the platform.
Section 03
Photo Delivery
- Photographers must deliver the agreed number of edited, high-resolution photos within a reasonable and acceptable timeframe.
- While delivery times may vary, Photo Trips recommends delivering within 7 days of the shoot.
- The delivery timeframe must be stated clearly on the photographer’s Photo Trips listing and adhered to once a booking is made.
Section 04
Photographer Payment
- Photographers receive 80% of the booking value, excluding taxes and payment processing fees.
- Payment is made only after the photoshoot has been completed.
- Once a photoshoot is marked as completed, a payout request is automatically created on the photographer’s behalf.
- Payments are processed within up to 5 business days via the payout method selected by the photographer.
- Photographers are responsible for covering any transaction or transfer fees related to their chosen payout method.
Section 05
Taxes
Photographers are solely responsible for determining and paying any taxes, duties, or governmental fees required in their country of residence or operation. Photo Trips does not withhold or remit any taxes on behalf of photographers.
Section 06
Photographer Conduct & Customer Experience
- Maintain professional, respectful, and courteous behavior toward customers at all times.
- Follow local laws and regulations during photoshoots, including permit requirements.
- Provide clear communication, offer posing guidance, and ensure a positive customer experience.
- Any behavior that negatively impacts the customer experience or Photo Trips’ reputation may result in removal from the platform.
Section 07
Usage Rights
- We value the artistic effort of photographers and respect their work. Photographers retain the copyright to all photos they take during Photo Trips bookings.
- Photographers must deliver the agreed number of edited, high-resolution photos to the customer and grant them a non-exclusive, non-transferable license for personal use.
- Photographers may not use photos featuring customers without the customer’s prior consent.
- If the customer consents, Photo Trips receives a perpetual, worldwide, royalty-free license to use those customer photos on its website, social media channels, and marketing materials, strictly for promotional purposes. Photo Trips will never sell customer photos to third parties.
- Photographers may use photos featuring customers on their own website or personal social media, provided they have obtained direct consent from the customer. Note that Photo Trips does not share information about consent given through the platform — it is the photographer’s responsibility to obtain this permission separately.
- Photographers may not use, publish, sell, license, or distribute any photos taken during Photo Trips bookings on third-party platforms, marketplaces, stock photography websites, booking platforms, agencies, or any other external platforms not owned or controlled by the photographer.
Section 08
Non-Exclusivity
Photo Trips does not require exclusivity. Photographers are free to work with other platforms, agencies, or clients simultaneously, provided they fulfil their Photo Trips commitments and comply with these Terms — in particular the Non-Solicitation clause (Section 9).
Section 09
Non-Solicitation
- Photographers agree not to directly solicit, contact, or accept bookings from any customer they were introduced to through Photo Trips, outside of the platform.
- This applies to all contact methods, including phone, email, social media, and in-person communication.
- Any attempt to bypass the platform may result in removal and loss of pending payments.
Section 10
Communication Rules
- All communication with customers before a confirmed booking must occur through the Photo Trips platform or approved channels.
- Photographers may not share personal contact details before a booking is confirmed.
- If a customer shares their own contact details before booking, the photographer must still keep all communication within the platform.
- Violations may result in suspension or removal from the platform and loss of pending payments.
Section 11
Quality Standards
- Use professional-grade camera equipment suitable for the booked shoot.
- Deliver sharp, well-composed, and properly edited images consistent with the style shown on your listing.
- Maintain clear and friendly communication.
- Offer guidance and location suggestions as needed.
- Consistent failure to meet these standards may result in suspension or removal.
Section 12
Liability
- Photographers are responsible for their actions and safety during photoshoots.
- They must take reasonable precautions to protect the safety of customers, themselves, and others.
- Photographers are liable for any accidents, injuries, or property damage they cause.
- Photo Trips will not be held responsible for such incidents, and photographers agree to indemnify Photo Trips against related claims.
Photographers are strongly encouraged to carry their own professional liability insurance to cover potential claims arising from injuries, accidents, or property damage during photoshoots. Photo Trips does not provide insurance coverage for photographers.
Section 13
Force Majeure
Photographers are not liable for missed sessions due to circumstances beyond their control, including illness, natural disasters, extreme weather, acts of government, pandemics, or civil unrest. In such cases, photographers must notify Photo Trips immediately to arrange rescheduling or replacement.
Section 14
Confidentiality
- Treat all customer information as confidential.
- Do not share or use customer details for personal marketing outside of Photo Trips.
- Do not share customer photos without their explicit consent.
- Breaches may result in removal and possible legal action.
Section 15
Equipment Responsibility
Photographers must maintain their own professional-grade equipment, including backups, to avoid disruptions to the shoot.
Section 16
Prohibited Conduct
No harassment, discrimination, abuse, intoxication, illegal substances, or unsafe behavior is permitted during shoots.
Section 17
Profile & Content Accuracy
Photographers must keep their profile, portfolio, and package descriptions accurate and up to date. Misrepresentation may lead to removal.
Section 18
Compliance With Laws & Permits
Photographers must comply with all applicable laws during shoots. If permits or fees are required for a location, they must inform Photo Trips and the customer in advance and clarify who will cover the associated costs.
Section 19
Account Suspension or Removal
Photo Trips may suspend or remove a photographer for repeated violations of these Terms, poor customer reviews, or behavior deemed damaging to the Photo Trips brand or community.
Section 20
Data Backup
Photographers must securely back up all customer images until delivery is confirmed, to prevent loss due to technical issues.
Section 21
Modifications to Terms
Photo Trips reserves the right to update or modify these Terms at any time. We will notify photographers of material changes by email or via a prominent notice on the platform at least 14 days before the changes take effect. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms. We encourage photographers to review these Terms periodically.
Section 22
Applicable Law & Dispute Resolution
- These Terms are governed by the laws of the country where the photoshoot takes place.
- Disputes are subject to that country’s courts.
- All platform activity remains subject to Photo Trips’ global operational rules.
- Both parties will attempt good-faith negotiation or mediation before legal action.
Section 23
Other Conditions
Any matters not explicitly covered in these Terms will be handled at Photo Trips’ discretion, in accordance with applicable law. Decisions will be final if reasonable and lawful.
